Hawaii County Sued Over Unconstitutional Firearm Permit Denial

Attorneys Kevin Gerard O’Grady and Alan Alexander Beck have filed a lawsuit on behalf of Roy Thompson against Hawaii County, challenging the constitutionality of the county's practices in issuing Permits to Acquire (PTA) firearms. Roy Thompson, a Hawaii National Guard veteran, had his PTA application denied due to his affirmative answer about receiving medical treatment for a condition, despite being a lawful firearm owner with no disqualifying conditions. The lawsuit argues that this denial violates Thompson’s Second Amendment rights, especially given the Supreme Court's 2022 decision in *New York State Rifle & Pistol Ass'n, Inc. v. Bruen*. It also claims that Hawaii County's practices are based on outdated state laws, unlawfully restricting firearm ownership. The lawsuit seeks declaratory and injunctive relief to prevent these practices and demands the issuance of Thompson’s PTA. The attorneys are focused on defending constitutional rights and ensuring compliance with legal precedents to protect the rights of all Hawaii residents.
